Terms of Service

1. Acceptance of Terms

By creating an account or using SES Mailbox in any way, you agree to be bound by these Terms of Service ("Terms"). If you are using SES Mailbox on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the service.

2. Description of Service

SES Mailbox is a SaaS email marketing platform that allows you to manage subscriber lists, build email campaigns, and send them via your own Amazon Web Services (AWS) Simple Email Service (SES) account. We provide the platform and tooling; email delivery is performed through your own AWS infrastructure.

3. Account Registration

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorised access to your account.
• You must be at least 18 years old to create an account.

4. Acceptable Use

You agree not to use SES Mailbox to:

• Send unsolicited commercial email (spam) or email to recipients who have not opted in
• Send email containing malware, viruses, phishing content, or deceptive material
• Violate any applicable law or regulation, including CAN-SPAM, GDPR, and CASL
• Harvest email addresses without the knowledge and consent of recipients
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the service or AWS infrastructure
• Attempt to gain unauthorised access to any part of the platform

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. AWS Credentials & Your Responsibility

SES Mailbox connects to Amazon SES using AWS access keys you provide. You are solely responsible for:

• The security and proper management of your AWS credentials
• Ensuring your AWS account complies with AWS's Acceptable Use Policy
• Any charges incurred in your AWS account as a result of using SES Mailbox
• Maintaining SES production access and adequate sending limits

SES Mailbox is not responsible for any AWS account suspensions, rate limiting, or additional charges.

7. Your Data

You retain ownership of all data you upload to SES Mailbox, including subscriber lists and campaign content. By using the service, you grant us a limited licence to store and process your data solely to provide the service. We do not claim ownership rights over your data. You can export or delete your data at any time. Please refer to our Privacy Policy for full details.

8. Intellectual Property

SES Mailbox and all associated software, designs, and content are owned by us or our licensors and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the platform for your internal business purposes. You may not copy, modify, distribute, or create derivative works from any part of SES Mailbox without our written consent.

9. Disclaimer of Warranties

SES Mailbox is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free, nor do we guarantee email deliverability or any particular outcome. Your use of the service is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, SES Mailbox and its officers, directors, and employees shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total aggregate liability shall not exceed the total fees you paid to us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SES Mailbox from and against any claims, damages, losses, and expenses (including legal fees) arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you send through the platform.

12. Third-Party Services

SES Mailbox integrates with third-party services including Amazon Web Services and PayPal. Your use of those services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

13. Service Availability & Changes

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the service at any time with reasonable notice where possible.

14. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in abusive conduct. You may terminate your account at any time from your settings. Upon termination, your right to use the service ceases immediately.

15. Governing Law

These Terms are governed by applicable law. If any provision is found to be unenforceable, the remaining provisions remain in full force.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the platform at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.
